The Will of Thomas Christopher – 20 December 1649

In the name of God Amen I Thomas CHRISTOPHER of Lulworth in the County of Dorsett doo Committ my soule to Allmighty Gods great game, it and my body to the Earth from whence it was taken, and further I doo by this my last will and Testament give unto my daughter ffrancis [Frances] CHRISTOPHER viz Inprimio [in the first place] ffoure fcore [four score] pounds of English money due upon bonds from Mr. John TURBOLFEILD [Turbervilles] of Bear [Bere] in the County of aforesayd to be paid unto mee the 25 of March next after the date of these presents and I doo further allow and by these presents give her full power to recover (in case of refusall) the sayd eighty pounds due from the sayd Mr.TURBOLFEILD by suite of lawe or otherwise; And also that upon payment of the sayd eighty pounds Mr.TURBOLFEILD, I doo by these presents give her full power to give him release and discharge for the same; Item I give unto my welbeloved daughter ffrancis CHRISTOPHER by this my last will and testament the summe of twenty pounds now in the hands of Richard GOULD of West Holme and I doo by these presents give her full power to sue the sayd Richard GOULD in case of non payment and to discharge him by release under her hands at the payment of the sayd money by Mr. Goulds to her or her assignee; Item I give unto my welbeloved daughter ffrancis CHRISTOPHER one Redd Rugg and payer [pair] of blanketts and one featherbedd one feather boulster and one dorone pillow and one feather pillow and two payer of shooter now in the hands of my sonne Thomas CHRISTOPHER of St Andrews in the County of Dorset; Also I doo further give unto my sonne William CHRISTOPHER now of London the summe of Ten Pounds which by this my last will and Testament I doo appointe my daughter ffrancis CHRISTOPHER to pay unto him out of the twenty pounds due from Mr. Richard GOULD or any of the summe shee shall receive of myne; Item I give unto my sonne Thomas CHRISTOPHER now of St Andrews one Tableboard and one wainscot chayer [wooden chair often with scroll arms and a solid panel back] and what money shall then in my hands soe it regard not above Twenty Shillings, and the rest to be paid to my daughter ffrancis CHRISTOPHER; Item I give unto my wellbeloved daughter PASCUE MIDWAY the Relict of Richard MIDWAY Clarke the summe of Ten Shillings to be paid unto her by my daughter ffrancis CHRISTOPHER out of such money as she shall receive of myne; Item I give unto my well beloved wife Joan CHRISTOPHER the summe of Tenn Shillings to be paid to her by my daughter ffrancis CHRISTOPHER out of such money as she shall receive of myn; Item I give unto my well beloved sonne Willian CHRISTOPHER of London and Roane GOLDING now in my custody one saddle and bryde [bridle] belonging to the sage horse in case the horse live till my death; Item I doo by this my last will and Testament save and keep all the right and propriety of the sayd goods and moneys due from Mr.GOULD and Mr.TURBOLFEILD soo long as I shall live but in case I should die before the receipt of the sayd money from them this my will to stand in force and virtue; And further it is my will that when soever I dye what soever money I shall have about me or in the hands of the sayd Mr.TURBOLFEILD or Mr.GOULD or any other that is to be paid unto my daughter ffrancis CHRISTOPHER who I appointe by this my last will and Testament to be the relate and sole executrix to my estate in witness re hereunto I have sett my hand and seal the Twentith day of December Anno one thousand six hundred fforty nyne The marke of Thomas Christopher Signed Sealed and Delivered in the presence of ffrancis Alleine to be the last will and Testament of Thomas CHRISTOPHER senior with one interlyne Francis Alleine.

This Will was proved at London before John Eaton Doctor of Lawe and surrogate to the right worshipfull Sir Nathaniell Brent Knight Doctor of Lawe and Master or Keeper of the Prerogative Court the last day of December in the year of our Lord God one thousand six hundred and fifty one by Oath of ffrancis CHRISTOPHER the deceased daughter and executrix therein named; To whom Administration of all and singular the goods chattels and debts of the sayd deceased which any manner or way concern the same will was granted and committed shee being first legally sworne well and truly to administer the same / Eve

Notes by Michael Russell 26 April 2005:-

1) I have looked in the Parish Registers for Dorset on the OPC Website for names similar to this and I have found a family by the name of Turbervilles. The most prominent of these families are the Lords of the Manor at Bere Regis who owned the Manor from the 13th Century right through to the 18th Century. Thomas Hardy seems to have used their name in his novel Tess of the d’Urbervilles.

The family seems to have spread across Dorset appearing in many parish register such as Wareham. The name is often spelt differently such as Tubervile; Turbervil; Turbervile; Turbervill etc and many are described as “Gentlemen” It is interesting that the Parish of East Lulworth has the following entries in its burial register:-

1703 in East Lulworth John Turbervil gentleman buried Canary Close and in, 1716 presumably his wife Mrs Turbervill in Canary Close

2) The Gould family is also shown in Dorset back to at least the 16th Century and some described as Gentleman. West Holme is between Wareham & Lulworth

3) There are families of Midway / Medway/ Meadwaye in the area but the best translation that I can come up with for her Christian name is Pascue


The Will of John Cox – 16 January 1691/92

In the name of God Amen the Sixteenth day of January in the Third Yeare of the Reigne of our Sovereigne Lord and Lady William and Mary by the Grace of God of England Scotland ffrance and Ireland King and Queene Defender of the ffaith etc. Anno Dm 1691 I John Cox of East Lulworth in the County of Dorset Seaman being in good health of body And of sound and perfect Mind and Memory Prayse be therefore given to Almighty God Doe make and ordaine this my present last will and Testament in manner and forme following that is to say ffirst and principally I Commend my Soule into the hands of Almighty God hopeing through the merritts Death and Passion of my Saviour Jesus Christ to have full and ffree pardon and forgivenesse of all my Sinns and to Inheritt Everlasting Life and my body I committ to the Earth to be Decently buryed at the discretion of my Executrixes hereafter named And as touching the disposition of such Temporall Estate as it hath pleased Almighty God to bestow upon me I give and Dispose thereof as followeth ffirst I will that my Debts and funerall Charges shalbee paid and Discharged I doe give and bequeath Unto my loving Mother Mary Smedmore the now Wife of John Smedmore the Summe of ffifty Shillings of lawfull English money I doe give and bequeath unto my Unckle Lewis Cox of West Lulworth the summe of ffive pounds of like lawfull English money I doe give and bequeath Unto my Kinsman Thomas Cox sonne of my Unckle Lewis Cox the like summe of ffive pounds of like lawfull English money I doe give and bequeath unto my Sister Elizabeth Smedmore ffifty shillings of like lawfull English money All the rest and residue of my Personall Estate Goods and Chattells whatsoever not before herein given and bequeathed I doe give and bequeath Unto my loving Sisters Mary Cox and Anne whom I doe make Joynt full and Sole Executrixes of this my last Will and Testament and I doe hereby revoke Disannul and make voyde all former Wills and Testaments by me at any time heretofore made In Witness whereof I the said John Cox to this my last will and Testament being conteyned in one Sheete of Paper have Sett my hand and Seale the Day and Yeare above written Signed John Cox

In the Name of God Amen I Charles Ricketts of the Parish of East Lulworth Laborer In the County of Dorsett do make this my last Will and Testament First I Give unto my beloved Wife Elizabeth Ricketts all my Moneys I shall be possest of at the Time of my Death and also my House and Household goods so long as Shee shall live and at my Wife’s Death all such Moneys and Goods of All kinds in Doors and out my Will is that it shall be divided between my own Family and my Wife’s That is to say One half to John Luccas of Woollbridge in the County of Dorsett And the other half to be Equaly Divided between my Brother William Ricketts taylor of East Lulworth And Mary Jeanes also of East Lulworth And also Too the Children of my Sister Elenor Allen of Woollbridge And also if James Rickett son of James Ricketts Decest late of Ham Worthy in the County of Dorsett should be living at the time of my Wife’s death he shall have an Equal Part with my Brother Sister and Sister’s Children And also if Either of them should happen to die before my Wife then it shall be Divided between them living

The Will of Aaron Roberts – 15 November 1820

This is the last Will and Testament of me Aaron Roberts of East Lulworth in the County of Dorset Yeoman made and published this fifteenth day of November One thousand eight hundred and twenty Whereas I have by Indenture bearing date this fifteenth day of November instant conveyed All that piece or parcel of land now in my occupation and in Lease to me at East Lulworth aforesaid to Thomas Weld Esquire for the Sum of One hundred pounds to be paid to such person or persons as should in and by my last Will and Testament nominate and appoint Now I do by this my said Will give devise and bequeath the said sum of One hundred pounds unto and amongst my five Children Elizabeth, Ann the Wife of James Merry, Carpenter, Theresa, Frances and Thomas equally to be divided between and amongst them share and share alike And Whereas I have in the hands of the said Thomas Weld the sum of Two hundred and ten pounds the Interest of which said sum of Two hundred and ten pounds I give and bequeath unto my wife Mary for and during her natural life if she shall so long continue my Widow and unmarried And from and after her decease or Marriage which shall first happen I give and bequeath the said sum of Two hundred pounds to my six Children Elizabeth Ann the Wife of James Merry aforesaid, Theresa, Frances, Thomas and Moses equally to be divided between them share and share alike I give devise and bequeath unto my said Wife for and during her natural life if she shall so long continue my Widow and unmarried All that my Leasehold Cottage and Premises at East Lulworth aforesaid now in the occupation of Susannah Decker And from and after her decease or Marriage which shall first happen I give and devise the said Cottage and Premises unto my three Sons Moses Aaron and Thomas as tenants in Common Also I give and bequeath All my Household Goods and Furniture Plate Linen and China unto my said Wife Mary for whole and sole use benefit and disposal And lastly I give devise and bequeath unto my said Son Aaron All my stock crop and implements in Husbandry and do nominate my said Son Aaron whole and sole Executor of this my said last Will and Testament and do hereby authorise my said Son Aaron to deduct the expences incurred by him in proving the same and of my personal estate and effects The Mark X of Aaron Roberts

The Will of John Tuexbury 1778 with Codicil 1780

This is the Last Will and Testament of me John Tuexbury of East Lullworth in the County of Dorset Malster made and published this Tenth Day of November in the Year of our Lord One Thousand Seven Hundred and Seventy Eight as follows (that is to say). First I give and bequeath unto my Son John Tuexbury the sum of Ten Pounds. Also I give unto my Daughter Mary Roberts the sum of Ten Pounds. Also I give unto my Daughter Elizabeth Smith the sum of Ten Pounds and my Will is that the aforesaid Legacies of Ten Ponds to my said Son John and my said Daughters Mary and Elizabeth shall be severally paid to them at the End of one Year next after my decease and not before. Also I give unto Judith my Wife the Use and Occupation of the House wherein I live and of the Outhouses and Garden thereto belonging for the Term of one Year next after my decease and from and after the End of the said one Year I give and bequeath the same Dwellinghouse, Outhouses and Garden unto my Three Children (by my first Wife) John Tuexbury Mary Roberts and Elizabeth Smith equally between them during the Remainder of my Term therein. Also I give unto my said Three Children All the Household Goods which I had at the Death of their Mother to be equally divided between them and to be delivered to them at the End of One Year after my decease and not before. Also I give and bequeath unto my said Wife Judith during so long Time as she may remain a Widow in my Name All that my Copyhold Cottage and Garden which I hold under Thomas Weld Esquire (as sole Purchasor [?]) by Copy of Court Roll of the Manor of East Lullworth aforesaid for my own Life and the Lives of Mary my Daughter and George Morey my Grandson. And also the Stable at the West End of my said Dwellinghouse (if my Estate and Interest shall so long continue therein). And from and after the Death or Marriage of my said Wife with a second Husband Then I give and bequeath the Same Cottage Garden and Stable and all my Estate Term and Interest therein unto my Daughter Sarah her Executors Administrators and Assigns for the Remainder of my Interest therein. All the Rest Residue and Remainder of my Estate Goods Chattels and Effects I give unto Judith my said Wife for ever [?]. And Lastly I do make and appoint my said Wife Judith whole and sole Executrix of this my Last Will and Testament hereby revoking and making void all former Wills by me made. In Testimony whereof I have hereunto set my Hand and Seal the Day and Year first above Written. The mark X of John Tuexbury. Signed sealed and published in the Presence of Robt. Lambert John Sparrow.

I the above named John Tuexbury the Testator do this 19th Day of April in the Year of our Lord One Thousand Seven Hundred and Eighty make and publish this as a Codicil to my Last Will and Testament above written and do hereby ratify and confirm the same and every Part thereof. I give unto my Son John Tuexbury the sum of Ten Pounds to my Daughter Mary Roberts Ten Pounds and to my Daughter Elizabeth Smith Ten Pounds which makes what I give them Twenty Pounds each and if they or either of them are indebted to me at the time of my decease such Debtor Debts shall be deducted out of the respective Legacy by my Executrix. It is my Will and I do hereby direct that there shall be Liberty for the Person or Persons who for the Time being shall be entitled to or possessed of the Copyhold Cottage to go through my Dwellinghouse and Garden to clear the water course at the back part of the said Copyhold House (there being no other way to the same) and in Case this my Will and Direction is not complyed with or should be disobeyed to the Detriment of the said Copyhold House I would wish the Possessor or Possessors of my said Dwellinghouse and Garden may only be obliged to comply and give such Liberty by due course of Law. The Twelfth Day of April 1783. This within written Will of John Tuexbury deceased was proved by the Oath of Judith Tuexbury Executrix within named to whom Administration was granted She being sworn well and faithfully to Administer the Goods Chattels and Credits of the said deceased also to exhibit a true and perfect Inventory thereof into the Court of the Bishop of Bristol and to render a just account of the same when there unto lawfully required. This is the last Will and Testament of me Judith Teuxbury widow of East Lullworth in the County of Dorset made this thirteenth day of October in the Year of our Lord Christ One thousand Eight hundred  and two whereby i disannul and make void any former will or wills heretofore made by me ffirst I do hereby Nominate and Appoint my Daughter Sarah Teuxbury sole Executrix and Administertrix to all my Personal Estate whatsoever and wheresoever any such be found at the time of my death and to her my said Daughter Sarah Teuxbury I give and bequeath all my Money or Monies and Securities for Money whatsoever and wheresoever any such be found at the time of my death with all my Goods Chattels and whatsoever I am possessed of to be received and by her and for her support so long as she shall live and to her Child or Children in case of any such living at the time of my said Daughter’s decease but in case my said daughter die without Issue then my will is that Thomas Molland Son of the Reverend Thomas Molland shall receive the Sum of one hundred pounds and the best of my Household Goods I give likewise after my Daughter’s death and in case of no Child Mr James ffirber or to his Children in case of his decease the Sum of one hundred pounds to the said Mr James ffurber of Steeple in the Isle of Purbeck I also will and order that after the death of my Daughter and in case of no Child that the Sum of one hundred pounds be put out for Interest on good Security and that the Interest of the said one hundred pounds be annually paid to the …. Collector of Monies for the support of Mr John Bannister now Minister of the Gospel to the Congregation Assembling in West Street in the Town and Borough of Wareham Dorset and to the said Mr Bannister’s Successors so long as the Orthodox belief is there taught by such Minister in succession and I do hereby choose and Appoint my ffriends Mr Jas ffirber aforesaid and John Strickland of East Holme Dorset to be my Executors in Trust for the defence and Security of my said Daughter and whatever concerns her Interest and Advantage and I give to the said John Strickland after the decease of my daughter the Sum of ffive pounds and I desire my daughter will make her will soon as conveniently after my decease and give the remaining part of my Money (not here given by me) to whom she my said Daughter pleases Signed and Sealed with my own hand day and date above written _ Judith Teuxbury _ Witnessed by use John Strickland _ Mary Grant

The Will of Sarah Tewxbury – 15 February 1803

This is the last Will and Testament of me Sarah Tewxbury Spinster of East Lulworth in the County of Dorset made this fifteenth day of February in the year of our Lord Christ one thousand eight hundred and three. First I will have all my just debts and funeral expenses be paid and discharged. I give at the time of my death John Stickland Bailiff to Nathaniel Bond Esq. the sum of one hundred pounds. I give and bequeath the sum of one hundred pounds to be put out on good security by my Executors in Trust hereafter to be nominated and the interest of the said sum of one hundred pounds to be annually paid by my Executors to the Rev. John Banister of Wareham Dorset and to his successors as long as he the said John Banister and his successors shall teach in the said Town of Wareham the Gospel of Christ under the Name of Orthodoxy. I give and bequeath the sum of one hundred pounds to the Missionary Society for the spread of the Gospel among the Heathen abroad. I give at the time of my death to John Tewxbury and Elizabeth Smith and Mary Roberts all the children of my Father by a former Wife the sum of five pounds each. I give to George Morey son of the said Elizabeth Smith the sum of five pounds. I give to Maria Puckett daughter of the said John Tewxbury the sum of five pounds. All the rest of my wearing apparel I give to the said Hannah Stickland and to the said Mary Firber to be equally divided between them. All the rest of my personal Estate whatsoever such as my House at East Lulworth my Household Goods my Monies Bills and Securities for Monies whatsoever and wheresoever (except what I have before given) I give and bequeath to Thomas Molland Son of the Rev. Thomas Molland of Thaxted in the County of Essex and I do hereby nominate and appoint the said Thomas Molland Junior my executor and administrator. But in case the said Thomas Molland, my chosen executor, should die without issue, then my will is that my household goods shall be given, that is to say, I give it, in such case, to the aforesaid John Stickland, excepting one large chest, and one pier glass, and one brass fender, which I give to the said Mary Firber and, in case my said executor Thomas Molland die without issue, then, in such case, I give my money, that is to say, the interest of all my monies found in the Bank of England, to the Rev. John Banister, of Wareham, and to the Rev. Benjamin Cracknell of Weymouth, and to their successors, the said interest to be given by them and their successors for the promulgation of the Gospel, and to be annually paid to them by my executors and assignees in trust, and by their successors to be nominated and appointed
by my appointed executors in trust, John Stickland aforesaid, bailiff to Nathaniel Bond Esq. of East Holme, in the county of Dorset, and the said James Firber Senior of Steeple in the Isle of Purbeck. My will is that my said executor Thomas Molland shall have power to sell out, and again buy in, my monies into the Bank of England, but not to waste or diminish the Sum that may first come to his possession. My house at East Lulworth shall be let at a moderate rent, and be made use of as a preaching house so long as my interest shall last in it and in case Thomas Molland die without issue, then shall my said house devolve to the aforesaid John Stickland and Executor. This Will was proved at London the twenty seventh day of April in the year of our Lord one thousand eight hundred and four before the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of the Reverend Thomas Molland the Younger the sole Executor named in the said Will to whom the Administration of all and singular the Goods Chattels and Credits of the said Deceased was granted he having been first sworn by commission duly to administer.

Anthony has added the following commentary:

This was followed by a case in the Court of the Exchequer: The Attorney General, at the Relation of John Foster and John Henry Crump v. Thomas Molland. July 3rd, 1832. “A testatrix bequeathed the sum of 100/.., to be put out on good security by her executors thereinafter to be nominated, and the interest to be annually paid by her executors to A. B., of W., and his successors, so long as he the said A. B. and his successors should teach in the said town of W. the gospel of Christ, under the name of orthodoxy. The evidence shewed that A. B., in the lifetime of the testatrix, preached to a congregation in W., of Calvinists, or, as they called themselves, orthodox independents. Held, that the minister for the time being of the congregation at which A. B. preached in the lifetime of the testatrix was entitled, so long as he preached the doctrines preached by A. B. in the lifetime of the testatrix, to the interest of the legacy.”

The gist of the case was that Thomas Molland had withheld the legacy of £100 due to Rev. John Banister (A.B.) and his successors at Wareham (W.). Click  here to see full report

The Will of John Tuxbury – 29 July 1825

The Last Will and Testament of me John Tuxbury of the Parish of East Lulworth in the County of Dorset Yeoman made this 29 of July one Thousand eight hundred and twenty five

In the first place I request my Executor herein after named to pay all my Just Debts and Funeral Expences owing at my Decease

I do nominate and appoint Joseph Cox of East Lulworth Carpenter to be my sole Executor

I give unto my said Executor the House and Land I hold on Lease under T Weld Esqr so long as the lives continue _ I further give him my said Executor all my Household goods Live and dead Stock, Corn, Hay, Implements in Husbandry and all book Debts with the exceptions herein after mentioned that is to say I do give unto my Daughter Mary Puckett of Chaldon widow within twelve calander months after my decease Forty Pounds of lawful money also my Clock and at the expiration of Two Years a further Payment of Four Pounds of lawful money to be paid the aforesaid Mary Puckman

I do also request my Executor to give to my Grandson John Puckett and Two Pounds of lawful money

I do also give unto my Grand daughter Sarah Tuxbury Cox my best Bed Bolster two Pillows and Bedstead

The Will of Edward Weld – 17 April 1755

In the Name of the Father and of the Son and of the Holy Ghost……I Edward Weld of Lullworth Castle in the County of Dorset calling to Mind the ffrailty and Uncertainty of Human Life being in Perfect Health Sense and Memory thanks be to Almighty God for the same being desirous to settle my Temporal Affairs in my lifetime that there may be no Occasion given of dispute whenever it shall please Almighty God to call me out of this miserable World ffirst then and chiefly I recommend my Soul to Almighty God my Creator and Redeemer humbly begging and firmly hoping through then Infinite Merits of the incarnation Passion and Death of my Dearest Saviour Jesus Christ and Remission of all my Sins to enjoy eternal Happiness in the life to come As to my body my Will is that it be interred without any Pomp as to the temporal Goods wherewith Almighty God has out of his Infinite Goodness been pleased to bless me I give and bequeath all except what is hereafter otherwise disposed of to my Eldest Son Edward Weld And Whereas pursuant to a power reserved by my Marriage Settlement I am at Liberty by Deed or Will to charge my Lands and Estates therein mentioned with the Sum of Six thousand pounds now in consequence of the said Power I do by this Will by me duly executed and attested by three Credible Witnesses as the said Power directs charge my said Lands and Estates with the Payment of the said Sum of Six thousand pounds And my Will is if my other Moneys and Effects do not amount to the Sums hereinafter bequeathed that this Sum of Six Thousand pounds shall be employed towards the Payment of them I Give to my Second Son John Weld Sum of ffive Thousand Pounds to my Third Son Thomas Weld the like Sum of ffive Thousand Pounds to my Daughter Mary Weld the Sum of Three Thousand Pounds I likewise give to my Sister Elizabeth Weld the Sum of ffive Thousand Pounds I likewise give to my said Sister Elizabeth Weld the Additional Sum of Two Thousand Pounds I also give to my Brother Thomas Simeon Weld the Sum of One Thousand Pounds and by this last Will do appoint him the said Thomas Simeon Weld my Executor and I do hereby further ordain that all Expences which may be occasioned by the Executor of this my Will and all my Debts be paid out of the Effects and Moneys belonging to me at the time of my decease I likewise desire that he will pay out of the same two years Wages to all my Menial Servants also I give to the Poor according to the discretion of my said Executor the Sum of Two hundred pounds In Witness whereof I have Signed Sealed Published and declared this to be my last Will and Testament this seventeenth day of April in the Year of our Lord 1755 Edward Weld

The Will of Mary Weld – 12 October 1827

This is the last Will and Testament of me Mary Weld Widow of Thomas Weld late of Lulworth Castle in the County of Dorset Esquire deceased I give unto my daughter Mary Weld the sum of one hundred pounds of lawful current money of England to be paid within six calendar months after my decease and subject to my just debts funeral and Testamentary expences and the charges of proving this my Will I give and bequeath the residue of of my monies personal Estate and effects whatsoever and the Securities for the same unto the Honorable Hugh Clifford and my Son Joseph Weld Esquire my Executors Administrators and assigns upon the trusts hereinafter mentioned (that is to say) upon trust that they the said Hugh Clifford and Joseph Weld and the Survivor of them his Executors or administrators do and shall as soon as conveniently may be after my decease appropriate the sum of one thousand two hundred pounds of lawful money of England and stand possessed of the same and the Interest thereof In trust for my daughter Elizabeth Bodenham the Wife of Charles Thomas Bodenham of Rotherwas in the County of Hereford Esquire and to pay and apply the same to such person form such persons for such purposes and generally in such manner as my said daughter shall from time to time or at any one time notwithstanding her coverture by any writing or writings under her hand or by her last Will and Testament or any writing in the nature thereof  direct or appoint so that the same may not be liable to the debts controul or Engagements of her present or any future husband and in default of such direction or appointment do and shall during the joint lives of my daughter and the said Charles Thomas Bodenham pay into the hands of my said daughter the Interest as the same shall become due of the whole or unappointed part of the said sum of one thousand two hundred pounds as the case may be upon her single receipt for the same and for her sole and separate use exclusively of her husband and in case my said daughter shall survive her said husband do and shall pay over and transfer the said sum of one thousand two hundred pounds and the Interest thereof and the Securities for the same to my said daughter for her own absolute use and benefit but in case my said daughter shall die in the lifetime of her said husband without having disposed or directed the disposition of the whole or a part of the said sum of one thousand two hundred pounds then I direct that the same or the part so undisposed shall be taken and go as part of the residue of my Personal Estate and upon this further trust that they the said Hugh Clifford and Joseph Weld and the Survivor of them his Executors or Administrators do and shall during the joint lives of my daughter and the said Charles Thomas Bodenham out of the Interest dividends and annual produce out of the residue of my Personal Estate not above disposed of pay into the hands of my said daughter and upon her single receipt for the same or to such purposes and for such purposes as she shall in any writing or writings under her hand from time to time  but not by may of anticipation appoint and so that the same may not be liable to the debts controul or Engagements of her said husband an annual sum of one hundred and fifty pounds of lawful current money of England by two half yearly payments the first half yearly payment to be made on the day on which the half yearly dividends of the English or foreign stocks or funds in which the principal shall be invested shall first become due after my decease but if the same shall not be so invested then within six months after my decease and in case my said daughter shall survive her said husband then upon trust that my said trustees and trustee do and shall with and out of the said Interest dividends and annual produce pay to my said daughter during her life an annual sum of two hundred and fifty pounds of lawful current money of England if the said annual produce shall amount to such annual sum otherwise the whole of such annual produce by two half yearly payments in the year the first half yearly payment to be made within six months of the decease of the said Charles Thomas Bodenham and upon further trust that my said trustees and trustee do and shall during the life of my said daughter lay out and apply the residue if any of the Interest dividends and annual produce of the residue of my Personal estate at their discretion in the Education of the children of my son Humphrey Weld Esquire and if the education of all his children shall have been before my decease and when the same shall have been completed and as to any part thereof which in their of his Judgment shall not be required for such purpose do and shall pay the whole or part as the case may be of such Interest dividends and annual produce as the same shall become due to my said Son Humphrey Weld his Executors Administrators and assigns and from and after the decease of my said daughter Elizabeth Bodenham I direct that my said trustees and trustee do and shall stand possessed of the residue of my personal Estate upon the trusts following that is to say as to the sum of one thousand pounds of lawful current money of England upon trust to pay the same to my said Son Humphrey Weld his Executors administrators and assigns and as to the sum of eight hundred pounds of like current money upon trust to pay the same to my son George Weld Esquire his Executors administrators and assigns and as to all the residue if any of my personal Estate and Effects upon trust to pay and transfer the same to my said Son Humphrey Weld his Executors administrators and assigns and I declare that the said several bequests shall be interests vested in the respective parties immediately upon my decease and I do hereby appoint the said Hugh Clifford and Joseph Weld Executors of this my will and I declare that if the trustees by this my will or to be by virtue of this present clause or any of them shall die or be desirous of being discharged from or become incapable of acting in the trusts hereby reposed in them it shall be lawful for my said daughter Elizabeth Bodenham and my said Son Humphrey Weld during their joint lives by any deed or Instrument legally executed by them and if the said Humphrey Weld shall depart this life in the lifetime of my said daughter then for my said daughter solely by any deed or Instrument to be so Executed by her and whether she be married or sole from time to time to appoint any other person or persons to be a trustee or trustees in the room of the trustee or trustees so dying or retiring and thereupon all the trust monies and premises shall be transferred in such manner that the same shall be effectually vested in the new trustee or trustees Jointly with the continuing trustee or trustees or solely as the case may require upon such of the trusts of this my Will as shall be then subsisting or capable of taking Effect and such new trustee or trustees shall have all the powers and authorities which by this my Will are conferred upon my trustees hereinbefore named And I declare that it shall be lawful for my trustees for the time being to vary and transpose any of the stocks funds or Securities upon which my Personal Estate or any part thereof shall be invested and from time to time to invest the same upon any of the Stocks or funds of Great Britain or upon Government or real Securities at Interest or upon the stocks or funds of any foreign nation such latter investments however not to be made without the consent in writing of the said Elizabeth Bodenham and of the said Humphrey Weld or his Executors or administrators and I further declare that my said trustees shall be respectively chargeable only with such monies they shall actually receive under the trusts of this my Will notwithstanding their joining in receipts for the sake of conformity and shall not be answerable for involuntary losses and that it shall be lawful for them respectively to retain and reimburse themselves of all such charges and expences they shall be put to in the Execution of the trusts aforesaid In Witness whereof I have to the first
